hereinafter referred to as the provider, the contract is concluded.

Contractual item

This contract regulates the sale of new goods from the field(s) of wine and other alcoholic beverages via the online shop of the provider. Due to the details of the respective offer, reference is made to the product description of the offer page.

Conclusion of contract

The contract is concluded in electronic business transactions via the shop system or via other means of distance communication such as telephone and e-mail. The offers shown represent a non-binding invitation to submit an offer by the customer order, which the provider can then accept. The ordering process for the conclusion of the contract includes the following steps in the shop system:

• Selection of the offer in the desired specification (size, color, number)
• Adding the offer to the shopping cart
• Pressing the 'order' button
• Entering the billing and delivery address
• Selection of the payment method
• Checking and processing the order and all entries
• Confirm the button 'order for a fee'

Confirmation e-mail that the order has been received. In addition to the shop system, orders can also be placed via remote communication means (telephone / e-mail), which means that the ordering process for the conclusion of the contract includes the following steps:

Contract period

The contract is concluded for an indefinite period.

Prices, shipping costs, return shipping costs

All prices are final prices and include the statutory value added tax. The minimum order value is € 15. The following flat-rate shipping costs apply once per order:

Germany - € 5,

EU - € 15.

In the case of partial deliveries, the lump sum is only charged once in each case. There are no further costs for shipping. This applies from an amount of € 150. If there is a right of withdrawal and it is used by this, the customer bears the costs of the return.

Payment terms

The customer has only the following payment options: advance bank transfer, credit card. Other payment methods are not offered and will be rejected. The invoice amount is to be transferred in advance to the account specified there after receipt of the invoice, which contains all the details for the transfer and is sent by e-mail. When paying by credit card, the customer must be the cardholder. The credit card will be charged after the goods have been shipped. The customer is obliged to deposit or transfer the indicated amount to the account indicated on the invoice within 3 days after receipt of the invoice. The payment is due without deduction from the invoice date. The customer is only in default after a reminder. A right of retention of the customer, which is not based on the same contractual relationship, is excluded.

Delivery terms

The goods will be shipped immediately after confirmed receipt of payment. The shipment takes place on average after 3 days at the latest. The entrepreneur undertakes to deliver on the 10th day after receipt of the order. The standard delivery time is 5 days, unless otherwise stated in the item description. The provider will ship the order from its own warehouse as soon as the entire order is in stock there. The customer will be informed about delays immediately.

Guarantees

The provider offers the customer a durability guarantee for its performance. With this, the provider guarantees the following quality for the warranty period: 6 months.

You have the right to revoke this contract within fourteen days without giving reasons.

The withdrawal period is fourteen days from the day,

• In the case of a purchase contract: in which you or a third party named by you, who is not the carrier, has taken possession of the last goods.
• In the case of a contract for several goods that the consumer has ordered as part of a single order and that are delivered separately: on which you or a third party named by you, who is not the carrier, have or has taken possession of the last goods.
• In the case of a contract for the delivery of a product in several partial shipments or pieces: in which you or a third party named by you, who is not the carrier, have or have taken possession of the last partial shipment or the last piece.
• In the case of a contract for the regular delivery of goods over a specified period of time: on which you or a third party named by you, who is not a carrier, took or has taken possession of the first goods.

When several alternatives meet, the last point in time is decisive.

In order to exercise your right of withdrawal, you must inform us (M.A.H.Bildungs- und Handels-GmbH, Evgeny Reznik, Alt-Mariendorf 60 12107 Berlin, +49 30 644 96 057 , evg.reznik@mozart-house.de ) by means of a clear statement (e.g. a letter sent by post, fax, or e-mail) about your decision to revoke this contract.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If you revoke this contract, we have to repay all payments we have received from you, including the delivery costs (with the exception of the additional costs arising from the fact that you have chosen a different type of delivery than the cheap standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged fees for this repayment. We can refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return the goods to M.A.H.Bildungs- und Handels-GmbH, Evgeny Reznik, Alt-Mariendorf 60 12107 Berlin immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract, +49 30 644 96 057 , evg.reznik@mozart-house.de to return or hand over to us. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the condition, properties and functionality of the goods.

End of the cancellation policy

Language, place of jurisdiction and applicable law

The contract is drawn up in German. The further execution of the contractual relationship takes place in German. The law of the Federal Republic of Germany applies exclusively. This only applies to consumers insofar as it does not restrict any legal provisions of the state in which the customer has his domicile or habitual residence. The place of jurisdiction for disputes with customers who are not a consumer, a legal entity under public law or a special fund under public law is the registered office of the provider.
